We know that misinformation can lead to confusion and worry, and we will do our best to keep you informed to the best of our abilities without putting the corporation at risk.
Council understands the importance of keeping residents up to date regarding legal matters before the courts. It is of the utmost importance that we note we are not at liberty to discuss our evidence in detail.
One of the reasons which we are not permitted to speak on legal matters is solicitor-client privilege. This applies to communications between the Town and our solicitor. These are communications made during the course of seeking or giving of legal advice, these communications are intended to be confidential between the client and the solicitor.
Solicitor client privilege is a substantive right and is central to the proper functioning of the legal system that allows us to communicate candidly and in confidence with our lawyer knowing that these communications are protected from disclosure.
We are cognizant of the fact that continuing court cases require financial investment. At this point, costs on our cases fall under solicitor-client privilege.
